Crafty Products Terms of Service

1. Business Identity

These Terms of Service govern the use of CraftyProducts.ca and purchases made from our online store.

CraftyProducts.ca is operated by Richard Lemoyne, a sole proprietor registered in Quebec, Canada, under the store name Crafty Products.

CraftyProducts.ca is an online retail store and the exclusive Canadian distributor of genuine products manufactured by Crafty Products Ltd. in the United Kingdom. Crafty Products Ltd. is a separate legal entity.

CraftyProducts.ca operates exclusively online. We do not have a retail storefront or offer customer pickup.

2. Acceptance of These Terms

By accessing CraftyProducts.ca, using the website, creating an account or placing an order, you agree to these Terms of Service and to the policies referenced in them.

If you do not agree with these Terms, you should not use the website or place an order.

You must have reached the age of majority in your province, state or country of residence to place an order, or place the order with the authorization of a parent or legal guardian.

3. Products and Product Information

We make reasonable efforts to ensure that product descriptions, photographs, prices and availability are accurate. However, colours and appearance may vary depending on the screen or device used.

All products sold through CraftyProducts.ca are genuine products sourced from Crafty Products Ltd. or its authorized supply chain.

Product descriptions, prices and availability may be updated without notice. We may discontinue a product or limit the quantity available for purchase. If an error materially affects an order that has already been placed, we will contact the customer and offer an appropriate correction or refund.

4. Prices, Currency and Payment

Prices are displayed in the currency selected on the website or presented during checkout. Applicable taxes, international shipping charges and any other charges are shown before the order is submitted.

Shipping is free for orders delivered within Canada and the United States. Shipping charges for other international destinations are calculated during checkout.

Payment must be successfully authorized before an order is processed. Customers are responsible for providing complete and accurate billing, payment, email and shipping information.

5. Orders and Cancellations

An order confirmation acknowledges that we have received an order. We reserve the right to decline or cancel an order because of unavailable inventory, an obvious pricing or product information error, suspected fraud, payment failure, shipping restrictions or another legitimate operational reason.

If we cancel an order after payment has been collected, the amount paid will be refunded to the original payment method.

Customers may request cancellation before an order has been shipped. We will make reasonable efforts to accommodate the request, but cancellation cannot be guaranteed once processing or shipping has begun.

6. Shipping and Delivery

Orders are shipped from Lévis, Quebec, Canada. Processing methods, estimated delivery times, shipping charges and tracking information are described in our Shipping Policy.

Delivery dates are estimates and may be affected by carrier delays, weather, customs processing, incorrect address information or other circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate delivery address. If an order is delayed, damaged in transit or not received, please contact us so that we can investigate with the carrier and provide any remedy required under applicable law.

International customers are responsible for any customs duties, import taxes or brokerage charges imposed by the destination country unless otherwise stated during checkout.

7. Returns and Refunds

Customers who change their mind may request a return within 14 days after delivery, subject to the conditions described in our Return and Refund Policy. For a change-of-mind return, the customer is responsible for the return shipping cost.

If a product is defective, damaged or incorrect, the customer should contact us within 30 days after delivery. When the return is accepted as defective, damaged or incorrect, Crafty Products will pay the reasonable return shipping cost or provide a prepaid return label.

Refunds are issued to the original payment method after the returned product has been received and inspected, subject to our Return and Refund Policy and applicable law.

These voluntary return periods do not limit any mandatory consumer rights or legal warranties.

8. Legal Warranties and Consumer Rights

Products sold to consumers may be covered by mandatory legal warranties, including warranties relating to normal use, reasonable durability, conformity with the product description and hidden defects.

Nothing in these Terms, our Return and Refund Policy or any other store policy excludes, restricts or replaces consumer rights or legal warranties that cannot lawfully be excluded.

Customers residing outside Quebec also retain any mandatory consumer protections provided by the laws applicable in their place of residence.

9. Privacy

Personal information is collected, used and disclosed in accordance with our Privacy Policy.

CraftyProducts.ca is hosted on Shopify. Shopify and other service providers may process information as required to operate the website, process payments, prevent fraud, fulfill orders and provide customer service.

10. Permitted Use of the Website

The website may be used only for lawful purposes. Users must not:

• provide false or misleading information;
• attempt to interfere with the security or operation of the website;
• introduce malicious software;
• infringe intellectual property or privacy rights;
• use the website to commit fraud or another unlawful act;
• collect information from the website through unauthorized automated means; or
• impersonate another person or business.

We may restrict access, cancel an order or close an account when reasonably necessary to prevent fraud, abuse, unlawful activity or harm to the website or its users.

11. Intellectual Property

Website content, including text, photographs, graphics, videos, logos and page designs, is owned by or licensed to Richard Lemoyne, Crafty Products, Crafty Products Ltd. or the applicable rights holder.

Crafty Products Ltd. remains the owner of its applicable brands, trademarks, product designs and other intellectual property. Shopify and other third parties retain ownership of their respective names, trademarks and services.

Website content may not be copied, reproduced, distributed or used commercially without authorization from the applicable rights holder.

12. Third-Party Services and Links

The website may contain links to or features provided by third parties, including Shopify, payment processors, shipping carriers and social media platforms.

Those third parties may have their own terms and privacy policies. We are not responsible for the content or practices of an unrelated third-party website. However, this section does not limit our responsibility for the sale of products purchased directly from CraftyProducts.ca.

13. Disclaimer and Limitation of Liability

We make reasonable efforts to keep the website available, secure and accurate, but we cannot guarantee that access will always be uninterrupted or free from technical errors.

To the fullest extent permitted by applicable law, Crafty Products is not responsible for indirect, incidental or consequential losses arising from the use of the website.

Nothing in these Terms limits liability or customer rights where such a limitation is prohibited by law, including liability relating to mandatory consumer protections and legal warranties.

14. Governing Law

These Terms are governed by the laws of the Province of Quebec and the applicable federal laws of Canada.

This provision does not deprive a consumer of any mandatory rights or protections available under the laws applicable in the consumer’s place of residence. Any dispute will be submitted to a court or authority having jurisdiction under applicable law.

15. Changes to These Terms

We may update these Terms when necessary to reflect changes to our operations, policies or legal obligations. The current version and its last-updated date will remain available on this page.

Changes will not retroactively reduce rights relating to an order placed before the change, except where required by law.
